If you are undocumented and are hurt at work, will they pay you?

Arizona law says that you are an employee even if you are not a legal citizen. This means that if you are hurt at work, your employer must pay you lost wages and help you pay for medical bills.

What lies do employers tell undocumented workers?

In the past, employers and businesses tried to tell employees who were hurt at work that they could not receive help because they were illegal citizens. That meant that injured workers would lose money in the following ways:

  • Income lost because you cannot work.
  • You were fired because you are injured and cannot work.
  • You have to pay for expensive medical bills.

Employers would even use people’s undocumented status to make them afraid to tell anyone or go to a doctor. However, anyone who is employed, even if they are undocumented, can receive workers’ compensation.

If you are undocumented and hurt at work, what should you do?

If you are hurt at work in Arizona, you can collect workers’ compensation. Even if you caused part of the accident that hurt you, you can still get help to pay your medical bills and be paid your wages.

A workers’ compensation claim can seem complicated and difficult, especially if English is not your first language. If you are injured at work, be sure to do the following:

  1. Get medical help as soon as you can.
  2. Tell your employer about your injury as soon as you can.
  3. Tell the Industrial Commission of Arizona about your injury.

If you do this, and your employer or their insurance deny your claim, you might need to look for help from a legal professional.
